§ 1. Parties and scope

1.1 These terms and conditions apply to any agreement for the hire of a tent and associated equipment concluded via telthuset.dk, by telephone or by email.

1.2 The lessor is Telthuset, operated by AInext.dk ApS, CVR no. 29513767, Klampenborgvej 239, 2800 Kongens Lyngby, Denmark, tel. +45 21 25 57 88, email info@telthuset.dk (the "Lessor").

1.3 The hirer is the person who makes the booking (the "Hirer"). The "Rental Item" means the tent with sides, guy ropes, pegs and any other equipment provided by the Lessor.

§ 2. Age and identification

2.1 The Hirer must be at least 18 years of age at the time of booking. The Lessor may request documentation of the Hirer's age and identity on delivery.

2.2 The Hirer is personally liable for all obligations under the agreement, regardless of whether the Rental Item is used by persons other than the Hirer.

§ 3. Conclusion of the agreement

3.1 The agreement becomes binding once the Hirer has completed the booking and received the Lessor's confirmation.

3.2 The Hirer must check that the information in the confirmation is correct and notify the Lessor of any errors without delay.

§ 4. Prices and payment

4.1 All prices are stated in Danish kroner (DKK) including VAT and cover delivery, set-up, take-down and collection within the Lessor's delivery area.

4.2 When booking, the Hirer chooses one of the following payment methods:

4.3 If the Hirer does not pay in cash on delivery, the Lessor is entitled to apply the deposit towards payment of the rent.

4.4 The booking is only completed once the payment or deposit has been approved. Payments are processed by Stripe Payments Europe Ltd. The Lessor does not receive the Hirer's card details.

4.5 For delivery on the day after the booking, a rush fee is added, as stated at the time of booking.

§ 5. Cancellation

5.1 The Hirer may cancel the agreement on the following terms, counted from the rental date:

5.2 Any amounts to be refunded are returned to the payment method used at the time of booking.

5.3 Cancellation must be made in writing to info@telthuset.dk or by telephone on +45 21 25 57 88 and takes effect when received by the Lessor.

§ 6. Right of withdrawal

6.1 The agreement is not subject to a right of withdrawal, as it concerns a rental for a specific date, cf. section 18(2)(xii) of the Danish Consumer Contracts Act. The Hirer may instead cancel in accordance with § 5.

§ 7. Delivery, set-up and collection

7.1 The Lessor delivers, sets up, takes down and collects the Rental Item at the agreed time and address.

7.2 The Hirer must ensure free and safe access for the Lessor and a level site suitable for the size of the tent (4 x 8 metres plus space for guy ropes).

7.3 The Hirer is responsible for ensuring that there are no wires, pipes, cables or similar in the ground at the site. The Hirer is liable for any damage to such installations arising from the set-up.

7.4 If set-up cannot take place due to circumstances for which the Hirer is responsible, the Hirer must pay the full rent.

7.5 On collection, the Rental Item must be cleared of furniture, decorations and waste. The Lessor may charge a reasonable cleaning fee if the Rental Item is returned in a substantially soiled condition.

§ 8. The Hirer's responsibility and liability for damage

8.1 The Hirer bears the risk for the Rental Item from the completion of set-up until the Lessor has collected it. The Hirer must handle the Rental Item with due care and in accordance with the Lessor's instructions.

8.2 The Hirer is liable for any damage to or loss of the Rental Item during the rental period, whether caused by the Hirer, the Hirer's guests or third parties.

8.3 In the case of repairable damage, the Hirer pays the Lessor's documented repair costs. If the Rental Item cannot be repaired economically or has been lost, the Hirer pays the replacement price of an equivalent new tent or equipment.

8.4 The use of barbecues, fires, torches, candles, heaters with an open flame or fireworks in or near the tent is not permitted.

8.5 It is not permitted to move, alter or partly take down the tent, or to apply tape, nails, staples, paint or similar to it.

8.6 The Hirer is advised to check whether the Hirer's own insurance covers damage to hired items.

§ 9. The Lessor's liability

9.1 The Lessor is responsible for ensuring that the Rental Item is in proper condition on delivery and is set up in a professional manner.

9.2 The Lessor is not liable for injury to persons or damage to property caused by the Hirer's use of the Rental Item contrary to these terms or the Lessor's instructions.

9.3 The Lessor is not liable for operating losses, loss of profit or other indirect losses.

§ 10. Force majeure

10.1 The Lessor is not liable for non-performance or delayed performance caused by circumstances beyond the Lessor's control, including extreme weather, illness, strikes, orders from public authorities or similar. In such cases, any rent already paid is refunded in full.

§ 11. Personal data

11.1 The Lessor processes the Hirer's personal data in accordance with the Lessor's privacy policy.

§ 12. Complaints and disputes

12.1 Complaints should first be addressed to the Lessor at info@telthuset.dk.

12.2 The Hirer may submit a complaint to the Danish Complaints Board (Nævnenes Hus), Toldboden 2, 8800 Viborg, Denmark. Consumers resident in another EU country may also use the European Commission's online dispute resolution platform.

12.3 The agreement is governed by Danish law. Disputes that cannot be settled amicably are decided by the Danish courts.
